International Travel Agreement

Definitions

For the purposes of this Agreement, the following terms have the meanings set out below:

“Fambul Tik Tours” or “Operator”

Refers individually and collectively to Fambul Tik Tours Sierra Leone, a Sierra Leone-registered tour operator licensed by the National Tourist Board of Sierra Leone and a subsidiary of TpGroup (SL) Limited, together with its directors, officers, employees, agents, guides, volunteers, subcontractors, independent contractors, representatives, successors, and assigns.

“TpISENT”

Refers to the US-based entity that processes participant payments on behalf of Fambul Tik Tours. TpISENT is a payment collection agent only and is not the tour operator. TpISENT does not organize, manage, or bear responsibility for any aspect of the tour itself.

“Program”

Refers to the Homecoming Sierra Leone tour itinerary organized and operated by Fambul Tik Tours, including all activities, accommodations, transportation, meals, cultural experiences, and events as described in the booking confirmation.

“Activities”

Means all activities and services arranged or organized by Fambul Tik Tours, including but not limited to transportation (public and private, air and sea), historic and cultural sites, beach visits, ocean swimming, boat excursions, hiking, community visits, and any other activities described in the itinerary.

“Participant”

Refers to the individual named on this Agreement who is enrolling in the Program. If the Participant is under 18 years of age, references to the Participant include the parent(s) or legal guardian(s) signing on their behalf.

1. Identification and Assumption of Risk

1.1. I understand that the Program takes place in Sierra Leone, West Africa, an international destination, and that there are inherent dangers, hazards, and risks associated with international travel and the specific activities of the Program. These risks include, but are not limited to:

• Weather conditions, including tropical heat, humidity, rain, and storms
• Disease, including but not limited to malaria, typhoid, yellow fever, cholera, and other tropical or communicable diseases
• Acts of God, force majeure, strikes, civil unrest, political instability, or terrorism
• War, conflict, or government action
• Quarantine, border closures, or public health emergencies
• Ocean, river, or other water-based activities, including boat travel to Bunce Island, Banana Island, and Atlantic Ocean swimming
• Road and traffic conditions in Sierra Leone
• Theft, loss of property, or personal security incidents
• Inadequate or unavailable medical facilities, personnel, or equipment
• Accidents or incidents involving third-party transportation, vessels, or facilities not owned or controlled by Fambul Tik Tours

1.2. I understand that my participation in the Program may involve risk of personal injury, illness, death, and loss of or damage to property, including the possibility of permanent disability.

1.3. I understand that Fambul Tik Tours does not own, maintain, or control all premises, facilities, or equipment used in the Program and cannot guarantee the safety, quality, or suitability of third-party services.

1.4. I ASSUME ALL RISKS, KNOWN AND UNKNOWN, FORESEEABLE AND UNFORESEEABLE, in any way arising from or connected with my participation in the Program, and I accept full personal responsibility for any injury, loss, death, illness, or damage that may result.

2. Medical and Health Responsibilities

2.1. I acknowledge that certain vaccinations and prophylactic medications are required or strongly recommended for travel to Sierra Leone, including but not limited to Yellow Fever (mandatory for entry). It is my sole responsibility to consult a licensed physician and the US Centers for Disease Control and Prevention (CDC) or relevant health authority regarding all required and recommended immunizations and health precautions prior to departure.

2.2. I confirm that I do not have any medical or physical condition that would make participation in the Program inadvisable or unsafe, or I have obtained physician clearance and disclosed relevant conditions to Fambul Tik Tours in writing prior to booking.

2.3. I acknowledge that medical facilities, treatment, and healthcare professionals in Sierra Leone may be limited, inadequate, or unavailable in certain locations during the Program. I accept this risk.

2.4. I represent and warrant that I will maintain comprehensive health and accident insurance, including medical evacuation coverage, throughout the Program and for the entire period of my absence from my country of residence. Fambul Tik Tours does not provide or arrange medical or travel insurance for participants.

3. Release and Waiver of Claims

I, individually and on behalf of my heirs, successors, assigns, executors, and personal representatives, hereby RELEASE, WAIVE, COVENANT NOT TO SUE, AND FOREVER DISCHARGE Fambul Tik Tours, TpGroup (SL) Limited, TpISENT, and each of their respective directors, officers, employees, agents, guides, volunteers, subcontractors, representatives, insurers, successors, predecessors, and assigns (collectively, the “Released Parties”) from any and all liability, claims, demands, causes of action, losses, damages, injuries (including death), costs, and expenses (including legal fees) of any nature whatsoever, whether known or unknown, arising out of, resulting from, occurring during, or connected in any way with my participation in the Program or any travel incident thereto.

This release includes, without limitation, claims arising from the Released Parties’ own negligence, errors, omissions, recklessness, or failure to act, to the fullest extent permitted by applicable law.

4. Indemnification

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, demands, losses, liabilities, costs, damages, and expenses (including reasonable legal fees) brought by third parties arising out of or related to: (a) my participation in the Program; (b) my breach of this Agreement; (c) my violation of any applicable law or regulation; or (d) my negligent or intentional acts or omissions during the Program.

5. Photography, Media, and Intellectual Property

5.1. I understand that the Program may be documented by Fambul Tik Tours and/or its media partners, including South Carolina Educational Television (SCETV), for documentary, promotional, and archival purposes.

5.2. By accepting this Agreement, I grant Fambul Tik Tours and its authorized media partners a non-exclusive, perpetual, royalty-free license to use my name, likeness, voice, and image in photographs, video recordings, and other media captured during the Program for marketing, educational, documentary, and promotional purposes, including on websites, social media, and broadcast media, unless I submit a written opt-out request at least 30 days before the Program start date.

5.3. I retain no right to compensation for such use. A separate Media Release form may also be provided and must be signed if required by the media partner.

6. Behavioral Standards and Removal

6.1. I agree to conduct myself in a manner that is respectful of Sierra Leone’s culture, traditions, communities, and laws at all times during the Program.

6.2. Fambul Tik Tours reserves the right to remove any Participant from the Program at any time, at the Operator’s sole discretion, for: (a) conduct that is disruptive, unsafe, or endangers other participants or local communities; (b) violation of Sierra Leone law; (c) violation of Program rules or Fambul Tik Tours’ standards of conduct; or (d) any behavior deemed incompatible with the Program’s objectives.

6.3. Removal from the Program for behavioral reasons does not entitle the Participant to a refund of any amount paid. The Participant is solely responsible for their own return travel costs and any other expenses incurred as a result of removal.

7. Citizenship, Ceremonies, and Cultural Activities

7.1. Fambul Tik Tours does not provide, arrange, guarantee, or bear responsibility for any Sierra Leone government citizenship process, diaspora registration, passport application, naming ceremony, chieftaincy ceremony, or other ceremonial or legal process of a governmental or community nature.

7.2. Any cultural or ceremonial activities arranged by Fambul Tik Tours are facilitated in good faith. Outcomes, including the recognition of any traditional title, honorific, or ceremony, are entirely at the discretion of Sierra Leonean community leaders, elders, or government officials. Fambul Tik Tours makes no representation regarding the validity, recognition, or legal effect of any such ceremony or process.

8. Itinerary Changes, Accommodation, and Force Majeure

8.1. Fambul Tik Tours reserves the right to modify the Program itinerary at any time for operational, safety, weather, health, or logistical considerations, while endeavoring to maintain the overall quality and character of the experience. The itinerary is a plan and not a contractual guarantee of any specific sequence of activities, venues, or timing.

8.2. Accommodation Disclosure:

• Kent Property in Freetown is the only accommodation owned by Fambul Tik Tours and is the only guaranteed property in the Program. All other properties (Lungi, Makeni, and Kabala) are third-party hotels selected on a curated basis and are subject to availability at time of travel.
• The Homecoming Program operates with a group size of 15 to 25 participants. Where the full group cannot be accommodated at a single third-party property, Fambul Tik Tours may arrange participants to be distributed across two nearby properties of comparable standard.
• Named third-party properties referenced in Program materials are illustrative of the standard and character of accommodation, not a binding commitment. Specific property confirmations will be provided no later than 30 days before departure.
• Fambul Tik Tours shall not be liable for the acts, omissions, standards, or failures of any third-party accommodation provider.

8.3. Fambul Tik Tours shall not be liable for any failure or delay caused by Force Majeure Events, including acts of God, war, terrorism, civil disturbance, pandemics, epidemics (including Mpox), quarantine, natural disasters, flooding, or any event that renders performance commercially impracticable or impossible. In such cases, Fambul Tik Tours may reschedule or offer a credit; no cash refunds will be issued for Force Majeure Events.

9. Payments and US Entity Disclosure

9.1. Tour payments made in the United States are collected by TpISENT, a US entity acting solely as a payment collection agent. TpISENT is not the tour operator, is not responsible for the delivery of any tour services, and is not a party to the travel agreement between me and Fambul Tik Tours Sierra Leone.

9.2. Receipt of payment by TpISENT does not constitute confirmation of a booking. Booking confirmation will be issued separately by Fambul Tik Tours Sierra Leone.

9.3. All disputes regarding tour services, itinerary delivery, or operational matters must be directed to Fambul Tik Tours Sierra Leone.

10. Governing Law and Jurisdiction

10.1. This Agreement is governed by the laws of the Republic of Sierra Leone. The Program is organized and managed by Fambul Tik Tours Sierra Leone, licensed under Sierra Leone law, and all activities take place within Sierra Leone’s territorial jurisdiction.

10.2. Any dispute arising from or related to this Agreement or the Program shall be submitted to the exclusive jurisdiction of the courts of the Republic of Sierra Leone.

10.3. Notwithstanding the foregoing, TpISENT’s payment-related obligations are governed by the laws of the State of Delaware, USA.

10.4. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full legal force and effect.

11. Insurance and Liability Limitations

11.1. Fambul Tik Tours’ professional liability insurance, if any, does not extend to claims arising outside Sierra Leone or to litigation in jurisdictions outside Sierra Leone.

11.2. To the fullest extent permitted by Sierra Leone law, the total aggregate liability of Fambul Tik Tours to any Participant for any claim arising from the Program shall not exceed the total amount paid by that Participant for the Program.

12. Participants Under 21 Years of Age

If the Participant is under 21 years of age, both parents or legal guardians must sign this Agreement. The parent(s) or legal guardian(s) accept all provisions of this Agreement on behalf of the minor Participant and assume all associated obligations, including indemnification and assumption of risk.
